Συνυπαίτιος ο οδηγός δικύκλου σε τροχαίο αν δεν φοράει κράνος!

 

Οδηγός δικύκλου που τραυματίστηκε σε τροχαίο αν δεν φοράει κράνος, δικαιούται μειωμένης, κατά 50%, αποζημίωσης για τις ιατρικές δαπάνες που θα καταβάλλει προς αποκατάσταση της υγείας του. Και αυτό, καθώς, η παράλειψή του να φορέσει κράνος τον καθιστά συνυπαίτιο στο τροχαίο, ακόμη και αν ο ίδιος δεν φέρει καμία ευθύνη για το συμβάν.

Η συγκεκριμένη απόφαση εκδόθηκε από το Μονομελές Εφετείο Πατρών και έχει επί της ουσίας δυο σκέλη. Το δικαστήριο ναι μεν επιδικάζεται αποζημίωση στον οδηγό του δικύκλου που τραυματίστηκε στο τροχαίο για ηθική βλάβη, ωστόσο, αποφαίνεται πως πρέπει να του καταβληθεί μειωμένο κατά 50% το ποσό που του είχε επιδικασθεί σε πρώτο βαθμό για τις δαπάνες αποκατάστασης της υγείας του.

Ειδικότερα, το δικαστήριο αφού προσδιόρισε το κόστος της θεραπείας του συγκεκριμένου οδηγού στις 2.500 ευρώ (αποκατάσταση θλαστικών τραυμάτων σε κεφάλι και πρόσωπο με χειρουργική επέμβαση, αμοιβές γιατρών, μετεγχειρητική παρακολούθηση, κ.ά), έκρινε εν τέλει πως το «ποσό της αποζημίωσης που δικαιούται (ο οδηγός) για τη δαπάνη αυτή πρέπει να μειωθεί κατά ποσοστό 50% και να του επιδικαστεί τελικά το ποσό των 1.250 ευρώ». Και αυτό γιατί – σύμφωνα μα με την απόφαση – «συνυπαίτιος στην επέλευση των ως άνω πολλαπλών θλαστικών τραυμάτων είναι και ο ίδιος, επειδή, κατά την οδήγηση του δικύκλου του, δεν έφερε προστατευτικό κράνος, το οποίο αν έφερε, μετά βεβαιότητας δεν θα είχε υποστεί τις ως άνω σωματικές βλάβες ή στην έκταση που τις υπέστη».

Ακόμη, με την απόφασή του το δικαστήριο, υποχρέωσε τον υπαίτιο πρόκλησης του ατυχήματος και την ασφαλιστική του εταιρεία να καταβάλλουν στο δικυκλιστή αποζημίωση και για ηθική βλάβη. Το συνολικό ποσό της αποζημίωσης ανήλθε στα 9.000 ευρώ (σε αυτό περιλαμβάνονται και οι επιδικασθείσες δαπάνες νοσηλείας). Αντίθετα, το πρωτοβάθμιο δικαστήριο είχε επιδικάσει στον οδηγό της μοτοσυκλέτας ποσό 14.407,40 ευρώ.
